1. Under the Australian Federal System, the States have legislative power over the regulation of food standards. However, a 1991 Commonwealth, State and Territory Agreement permits the adoption of a uniform food standard. As a result the Australia New Zealand Food Standards Code (the Code) applies within Australia. This Code is adopted and implemented through State legislation for domestic regulation and through the Imported Food Control Act 1991 (Commonwealth) for food importation (See Attachment A).

Domestic Standards
3. Australian wine production provisions are contained in Standard 4.5.1 of the Code -

General Standard
4. Wines imported into Australia must comply with the wine production provisions in Standard 2.7.4 and in Part 1.3 of the Code.

Note, the versions of the Code that appear on the Internet are unofficial consolidated documents containing all changes to the Standards. The Code published in the Gazette is the official legal document that is given legal force via State, Territory, Commonwealth and New Zealand food legislation. You are advised to refer to the Code published in the Gazette for legal purposes.
